What is repair-in-kind and why does it matter?
Repair-in-kind means restoring an existing structure to its original footprint, height and materials. It qualifies for the shortest review path because it creates no new impact on submerged lands. Moving a wall waterward even 6 inches converts the project into new construction with a full review.
Who issues each permit?
Hillsborough County Development Services issues the local building and shoreline permits. The Florida Department of Environmental Protection or the Southwest Florida Water Management District handles Environmental Resource Permits. Work touching navigable waters may also require a U.S. Army Corps of Engineers nationwide permit.
- County shoreline permit — 3 to 6 weeks typical
- FDEP/SWFWMD Environmental Resource Permit — 30 to 90 days
- Army Corps nationwide permit — often concurrent, 30 to 60 days
- HOA architectural review, where applicable — 2 to 8 weeks
What happens if seawall work is done without a permit?
Unpermitted shoreline work commonly results in a stop-work order, after-the-fact permit fees at double the normal rate, and in some cases mandated removal. It also becomes a disclosed defect at resale, and title companies routinely flag open permits at closing.
